Construction Industry Braces for Impact as NEMA Introduces Mandatory Sand Transport Permits

The National Environment Management Authority (NEMA) has implemented new regulations requiring all sand transporters to obtain a mandatory transportation permit, a move aimed at enhancing sustainable sand harvesting and curbing illegal transportation activities.

The directive, outlined in the 2024 Sand Harvesting Regulations, is expected to have a significant impact on the construction industry, potentially influencing sand prices and transportation logistics.

New Measures to Regulate Sand Harvesting and Transport

In a public notice issued on Tuesday, NEMA emphasized that the new regulations seek to control the extraction, movement, and trade of sand to protect the environment from excessive degradation caused by unregulated sand harvesting.

“Sand transporters are hereby notified that the 2024 Sand Harvesting Regulations mandate a sand transportation permit from NEMA. All sand transporters must apply for this permit immediately,” the authority stated.

The Ministry of Environment, Climate Change, and Forestry, under the leadership of Cabinet Secretary Aden Duale, officially published the 2024 Sand Harvesting Regulations on February 18, 2024.

These regulations introduce stringent controls on sand harvesting and transportation, ensuring environmental sustainability while promoting responsible resource utilization.

Permit Application Process and Compliance Measures

NEMA has directed all sand transporters to immediately apply for the required transportation permit through the agency’s Sand Harvesting Licensing Portal, accessible via the official NEMA website.

The new permit system is expected to:

  • Regulate sand harvesting activities to prevent environmental degradation.
  • Enhance transparency and accountability in sand transportation.
  • Ensure compliance with environmental laws and sustainable resource management.

Non-compliance with the regulations could result in legal consequences, including fines and suspension of transportation activities.

Implications for the Construction and Transport Sectors

The construction sector, which relies heavily on sand as a key raw material, could face short-term supply disruptions and potential cost increases due to the new regulatory requirements.

Industry stakeholders have expressed concerns over the bureaucratic processes involved in acquiring the permits, which may lead to delays in sand delivery for ongoing projects.

Additionally, the directive aligns with recent proposals by the National Transport and Safety Authority (NTSA) aimed at improving road safety by tightening regulations on loading and cargo securement for heavy commercial vehicles.

This dual approach is expected to enhance both environmental conservation and road safety standards.

A Step Towards Sustainable Sand Management

Kenya has faced growing concerns over unsustainable sand harvesting, which has led to environmental degradation, riverbank erosion, and loss of biodiversity.

The new NEMA regulations are part of the government’s broader efforts to curb illegal sand mining and promote responsible natural resource management.

As the enforcement of these regulations begins, industry players, transporters, and construction companies will need to adhere to the new requirements to ensure compliance and continued operations.

Meanwhile, NEMA has assured stakeholders that public engagement forums will be conducted to address any concerns and streamline the permit acquisition process.

With these measures in place, Kenya is taking a crucial step toward balancing economic development with environmental sustainability, ensuring that future generations continue to benefit from responsibly managed natural resources.
