Isiolo, Kenya| The High Court in Isiolo has issued temporary orders barring the County Assembly from proceeding with an impeachment motion against Governor Abdi Ibrahim Hassan(Guyo), in a move that marks a major legal and political twist in the escalating standoff between the executive and legislative arms of the devolved government.
Justice Nyaga Heston Mbogo, presiding over the matter, delivered a ruling on Monday, June 16, 2025, certifying Governor Guyo’s petition as urgent.
The court issued conservatory orders restraining both the Isiolo County Assembly and Speaker Mohamed Roba Qoto from debating or taking any further steps on the impeachment motion dated June 10, 2025, until the case is fully heard and determined.
The motion had been scheduled for tabling and debate on Tuesday, June 17, but the court’s decision effectively freezes any such proceedings, dealing a temporary legal victory to Governor Guyo and his administration.
In his application, Governor Hassan argued that the impeachment process was marred by procedural irregularities and lacked due process.
He further claimed that he was not provided with a copy of the motion or the supporting evidence, denying him a fair opportunity to respond to the allegations levelled against him.
The court echoed these concerns by directing Speaker Qoto to furnish the governor with a copy of the impeachment motion and all accompanying documentation within 48 hours.
In addition, all respondents named in the case — presumed to include the County Assembly and its leadership — have been given seven days to file their responses. Governor Guyo has also been granted three days thereafter to submit any supplementary affidavits.
The matter is set to return to court on June 30, 2025, for further directions, compliance assessment, and a possible hearing schedule.
The court’s intervention comes amid heightened political tension in Isiolo County, where the power struggle between Governor Guyo and some members of the County Assembly has been simmering in recent months.
While the reasons behind the impeachment bid remain formally undisclosed to the public, sources close to the assembly indicate that it may be linked to alleged financial mismanagement and abuse of office—claims that the governor has vehemently denied.
As the legal battle unfolds, the High Court’s move to suspend the impeachment process underscores the critical role of the judiciary in safeguarding constitutional processes and the rights of elected leaders to fair administrative action.
